- You have the right to oppose the dismissal of your immigration case. Usted tiene derecho a oponerse a la desestimación (terminación) de su caso de inmigración.
If you have recently arrived in the US and your immigration court case is dismissed, you are at risk of being arrested by ICE and quickly deported. So if the government tries to dismiss your case, you have the right to oppose the dismissal. You can also ask the judge for more time to explain why you want to continue your immigration case.
Si llegó recientemente a los estados unidos y su caso en la corte de inmigración es desestimado (terminado), corre el riesgo de ser arrestado por ICE (agentes de inmigración) y ser deportado rápidamente. Por lo tanto, si el gobierno intentó desestimar su caso, tiene derecho a oponerse. También puede solicitar al juez más tiempo para explicar por qué desea continuar con su caso de inmigración.
- If your case is dismissed, you have the right to appeal. Si su caso es desestimado (terminado), usted tiene derecho a apelar.
If the immigration judge dismisses your case, you can appeal this decision to the Board of Immigration Appeals, which will review the judge’s decision. If you wish to appeal, please tell the immigration judge you want to appeal.
Si el juez de inmigración desestima (termina) su caso, puede apelar esta decisión ante la junta de apelaciones de inmigración (Board of Immigration Appeals, por sus siglas en ingles), que revisará la decisión del juez. Si desea apelar, indique al juez de inmigración que desea hacerlo.
- If you fear persecution or torture in your home country, tell the judge at the hearing. Si teme ser perseguido o torturado en su país de origen, dígaselo al juez en la audiencia.
You have the right to apply for protection in the U.S., such as through asylum and withholding (Form I-589), if you fear returning to your country.
Usted tiene derecho a solicitar protección en los estados unidos, por ejemplo a traves de asilo y retención (formulario I-589), si teme regresar a su país de origen.
- 4. If you are arrested and have a fear of persecution or torture in your home country, tell ICE. Si lo arrestan y tiene miedo ser perseguido o torturado en su país de origen, informeselo a ICE.
If you are arrested by ICE, the government may try to quickly deport you.
